Understanding the Difference Between Statutory and Mandatory Training (And Why It Matters)

In health and social care, training isn’t just a box-ticking exercise—it’s the foundation of safe, high-quality support. But when it comes to compliance, the terms statutory and mandatory training are often misunderstood or used interchangeably. Understanding the difference is essential for providers to remain compliant, protect staff and service users, and prepare for inspections with confidence.

At TJS Solutions, we help organisations across the North West navigate these requirements with clarity—delivering our own tailored training, in addition to Qualsafe-regulated training that supports both statutory obligations and mandatory best practice.

What is Statutory Training?

Statutory training is training that is required by law. It exists to ensure that employees are working safely and that organisations meet their legal responsibilities under acts such as:

  • The Health and Safety at Work Act 1974
  • The Management of Health and Safety at Work Regulations 1999
  • The Fire Safety Order 2005

Examples of statutory training in health and social care include:

  • Health and Safety Awareness
  • Fire Safety
  • Manual Handling of Objects
  • Basic Life Support (in some roles)

Failure to deliver statutory training can leave an organisation open to prosecution, enforcement action, or fines from the Health and Safety Executive (HSE) and other regulatory bodies.

What is Mandatory Training?

Mandatory training is defined by your organisation, commissioners, or regulators (such as the CQC) as essential for safe and effective care delivery. It may not be required by law, but is necessary to meet professional standards and contractual obligations.

Examples of mandatory training include:

  • Safeguarding Adults and Children
  • Infection Prevention and Control
  • Medication Administration
  • Mental Capacity Act Awareness

Mandatory training ensures that care is delivered competently and consistently and helps demonstrate compliance with Regulation 18 of the Fundamental Standards, which requires providers to ensure that staff are appropriately trained and supported.

Why It Matters

Confusion between statutory and mandatory training can lead to serious gaps in compliance. For example, assuming fire safety is ‘optional’ or treating safeguarding training as a one-off exercise can expose staff, service users, and your organisation to avoidable risk—and scrutiny.

Understanding what is legally required vs. what is professionally expected helps you:

  • Create effective induction and refresher plans
  • Pass inspections with confidence
  • Protect your workforce and those you support
  • Avoid fines or enforcement action
  • Ensure the right training is delivered to the right people at the right time
